Version 4.1 commit failures due to duplicate key error

We are experiencing occasional commit failures with a java error concerning duplicate key error in servoy_elements. When the developer dismisses the error message he attempts to commit again and Eclipse acts as if there is nothing more to commit for that module. On the next sync for that developer all the work he completed that days comes back as 'deletions' which means Servoy/Eclipse wants to destroy a days work. None of the other team developers have these forms so the commit in fact failed.

Is there anyway for the developer to get his work to the repository? Is it lost? We are using MS SQL Server 2005 as the repository. A case has been created for this problem. I just hate to see a developer lose an entire days work because of errors in Servoy/Eclipse.
